Terms of Service — FinIQ

1. Acceptance of Terms

By accessing or using FinIQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User") and FinIQ ("we", "us", or "our").

2. Description of Service

FinIQ provides AI-powered analysis of financial documents, including but not limited to income statements, balance sheets, and cash flow statements, to generate summaries, insights, ratios, and related outputs.

The Service is provided on an "as-is" and "as-available" basis.

3. No Financial or Professional Advice

The Service is provided for informational purposes only. FinIQ does not provide financial, investment, legal, tax, or accounting advice. Nothing generated by the Service should be interpreted as such.

You acknowledge and agree that:

→The outputs are generated by automated AI systems
→The outputs may be incomplete, inaccurate, or outdated
→You must not rely solely on the Service for decision-making
→You should seek independent professional advice before making any financial or business decisions

4. User Responsibility

You are solely responsible for:

→Any decisions or actions taken based on the Service
→Verifying the accuracy and suitability of any outputs
→Ensuring your use complies with applicable laws and regulations

FinIQ is not responsible for any outcomes resulting from your use of the Service.

5. Limitation of Liability

To the maximum extent permitted by law, FinIQ shall not be liable for any direct, indirect, incidental, consequential, or special damages, including loss of profits, revenue, business opportunities, or data arising from or related to your use of the Service.

If liability cannot be excluded, FinIQ's total liability shall not exceed the amount paid by you (if any) for use of the Service in the preceding 12 months.

6. No Warranties

The Service is provided without warranties of any kind, express or implied, including but not limited to accuracy, completeness, or reliability of outputs, fitness for a particular purpose, or availability and uninterrupted operation. We do not guarantee that the Service will be error-free or meet your expectations.

7. Use of the Service

You agree not to:

→Use the Service for unlawful or fraudulent purposes
→Upload content you do not have the right to use
→Attempt to reverse engineer or exploit the system
→Interfere with or disrupt the Service

We reserve the right to suspend or terminate access for misuse.

8. User Content

You retain ownership of any documents or data you upload. By using the Service, you grant FinIQ a limited, temporary licence to process your content solely for the purpose of providing the Service. We do not claim ownership of your data.

9. Data Handling

We take reasonable steps to protect your data. However, you acknowledge that no system is completely secure, transmission of data is at your own risk, and uploaded documents may be processed using third-party AI providers.

10. Payments and Pricing

Certain features of the Service may require payment. By purchasing credits or subscriptions, you agree that fees are charged as described at the time of purchase, payments are non-refundable unless required by law, and we may change pricing at any time with notice. Unused credits may be subject to expiration as specified at purchase.

11. Intellectual Property

All rights, title, and interest in the Service (excluding user-uploaded content) are owned by FinIQ. You may not copy, reproduce, or distribute the Service without permission.

12. Termination

We may suspend or terminate your access at any time if you breach these Terms or we believe your use poses risk or harm. You may stop using the Service at any time.

13. Changes to the Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles.
